Analysis of the right to education in Chile: the pending challenge

Today, education is considered a human right and is a fundamental part of today's societies. However, the application of this right is strained by market principles and regulations that change and strain the public meaning of education. The case of Chile is no exception, considered one of the most privatized educational systems in the world, the right to education is crossed by mercantile interests. In this context, the article aims to analyze the implementation of the right to education in Chile according to the indicators proposed by (Tomasevski, 2006a) through his 4 - A's scheme. To this end, primary documentary sources, laws, decrees, review of states parties, among other documents, are reviewed. The results indicate that the right to education in Chile is fulfilled in some aspects (such as coverage and regulation) that have been regulated by decrees and legislation, but it has not been sufficient nor is it considered adequate due to the deep neoliberal orientation that has penetrated and installed in the educational communities.
