CRITICAL-REFLECTIVE ANALYSIS OF THE OFFENSE OF INSTITUTIONAL VIOLENCE TYPEFIED BY LAW No. 14,231/2022
Abstract
In this study, the crime of institutional violence typified by Law nº 14,231 of 10/28/2022 was analyzed. The deductive method of approach was used, in a qualitative and exploratory work that was operationalized through bibliographic and documentary research. Violence is discussed as a phenomenon, covering its concept, core characteristics and main forms of manifestation, focusing on the main elements of the crime of institutional violence. As a contribution, it was found that the crime was classified in a rushed manner, as a manifestation of Emergency Criminal Law and in violation of the principle of criminal taxation. Finally, measures are suggested to overcome and/or mitigate the gaps and deficiencies detected.
