A OPERACIONALIZAÇÃO DO ACORDO DE NÃO PERSECUÇÃO PENAL NO ÂMBITO DO MINISTÉRIO PÚBLICO FEDERAL

Abstract
The article deals with the Non-Prosecution Agreement and its operationalization in the area of consensual criminal justice, as a way of demonstrating the viability and adequacy between the exercise of the accusatory power of the holder of the public criminal action and the fundamental rights of the person investigated, through consensual due process of law. To this end, it discusses consensual criminal justice; it deals with the main requirements of the non-prosecution agreement and its operationalization within the scope of the Federal Public Prosecutor's Office. In order to carry out the qualitative, exploratory research, the methodological instruments used were a bibliographical review of the categories that guide the work; documentary research and quantitative data provided by the 2nd Coordination and Review Chamber. The research points to the gradual evolution of the agreements signed, emphasizing the importance of the infralegal regulations, linked to the controls of constitutionality and conventionality, as a vector of guidance in ministerial action and legal certainty for the agreeing parties.
