JUSNATURALISMO CLÁSSICO E JUSNATURALISMO RACIONALISTA: ASPECTOS DESTACADOS PARA ACADÊMICOS DO CURSO DE DIREITO

Resumo

Direito natural é um tema recorrente na história e na filosofia do direito. O pensamento clássico caracteriza-se por dar-lhe fundamento cosmológico ou divino e conteúdo objetivo, referido à lei e não ao direito subjetivo. O século XVII marca o aparecimento de uma nova visão de direito natural, agora fundado na razão humana, convertendo-se numa teoria de direitos subjetivos. Essa concepção inovadora inspira revoluções, as modernas declarações de direitos e influencia decisivamente a teoria política e as modernas Constituições ocidentais. Ambas as versões da idéia de direito natural sofreram críticas, que vão desde a vagueza de conteúdo até a falta de sentido histórico concreto e a impossibilidade da construção de uma ciência jurídica sobre bases ideológicas. Entretanto, a idéia de direito natural nunca foi abandonada; revive com a resistência ao formalismo e o perene anseio por justiça.

Natural right is a recurrent subject in the history and philosophy of law. The classic thought is characterized by giving it cosmological or divine bedding and objective content, related to the law and not to the subjective right. In the seventeenth century there appears a new view on the subject of natural right, now based on human reason, being converted into a theory of subjective rights. This innovative concept inspires revolutions and the modern bills of rights, and decisively influences the western political theory and Constitutions. Both versions of the idea of natural law have been subject to criticism, which ranges from the indefiniteness of content to the absence of concrete historical meaning to the impossibility to construct a legal science on ideological bases. However, the idea of natural right has never been abandoned; it is reborn with the resistance to formalism and the perennial yearning for justice.
