é possível pensar aproximações a partir dos silenciamentos no campo?

Abstract

The present article addresses the Brazilian Psychiatric Reform (BRASIL, 2001) and its connections with "Restorative Justice" within the scope of the Criminal Justice System, focusing on the elements of community and accountability. To achieve this objective, an exploratory methodology based on bibliographic and documentary research was employed, considering the silences surrounding the topic in studies conducted within these specific fields. The data collected from publications of the Restorative Justice Network Project (2021) and the National Specialized Consultancy for the treatment and promotion of therapeutic measures applicable to individuals with mental disorders in conflict with the law, within the scope of the Fazendo Justiça Program (2021/2022) of the National Council of Justice, guided this investigation. These connections aim to foster reflections and critical inquiries regarding the punitive bias and mass incarceration practices that underlie judicial policies in Brazil. The study concludes that these themes enhance practices of autonomy and access to justice for individuals navigating the Criminal Justice System.
