Between the Statute of Children and Adolescents and Minorism: intersectionality and selectivity in the Brazilian socio-educational system

Abstract

This study analyzed the profile of young people in the juvenile justice system, connecting it to the concepts of "forgotten class" (Jessé Souza) and intersectionality between race, gender, and class (Carla Akotirene). The qualitative methodology, articulated with bibliographic research, sought to understand the overrepresentation of Black, poor, and marginalized youth in the juvenile justice system. It was found that, despite the Statute of the Child and Adolescent (ECA), punitive practices and structural racism persist, selecting these young people. The profile is predominantly male, marginalized, and Black, reflecting the continuity of historical stigmas. It is concluded that the system acts as a sociodemographic funnel, where "dangerousness" is socially constructed from social labels (Becker).
