Abstract
The article investigates the controversial thesis of the one right answer as combating the different forms of legal positivism, as well as the philosophical theses that support them, and its possibilities in the field of human rights. It also researches its application and scope in some recent cases tried by the Brazilian Supreme Court and the Inter-American Court of Human Rights.
