OS REFLEXOS DA CLASSIFICAÇÃO DA COVID-19 COMO DOENÇA OCUPACIONAL NO DIREITO PREVIDENCIÁRIO
Abstract
The main purpose of this study it to analyze the impact of COVID-19 in Brazilian Social Welfare Law taking as a basis the recent decision presented by the Supreme Court, which suspended, summarily, the effectiveness of the articles 29 and 31 of the Provisional Measure n. 927 of 2020. One of the results of this judgment is the possibility of classifying the COVID-19 as an occupational disease, which allows the person infected to seek accident benefits. So, this study examines the socioeconomic context caused by the pandemic, the set of welfare standards applicable to workers who suffer from occupational diseases and the social welfare benefits derived therefrom, as well as the possible discussions that arose after that decision.
