Dos efeitos da prisionização às Medidas Alternativas de aplicação da punição estatal
Abstract
This present work discusses the failure of the prison institution, as well as reflection of the deprivation of liberty in the human subjectivity. Providing a critical view on the subject in question, presenting possible alternatives to the deprivation of liberty, the treatment of the deviant, in order to diminish the criminal retributivist function. Qualitative, exploratory research is used, whose bibliographic procedure is centered under the aegis of bibliographic research. In the present case, it can be observed that prison produces on the custodian individual, different sufferings and physical and psychological subjects that end up with influences on the identity and subjectivity of the human being. Similarly, it follows the doctrinal understanding to recognize that the restriction of freedom, as a punitive means, that it isn’t longer an effective means of promoting justice and ensuring public order, and it is necessary to apply other punitive measures that are more effective for the resocialization and prisoners preservation.
