SOCIEDADE ANÔMALA DA IMPROBIDADE E CORRUPÇÃO E A PERSPECTIVA DO “DEVER SER” KELSENIANO

Abstract

The study aims to reflect on the (in) existence of a society focused on illegality within the scope of public administration, analyzing under the aspects of the pure theory of law and its peculiarities, with the purpose of discussing the distinction between “being "And the" should be "in the light of the Kelsenian theory the normality of the existence of these societies. The method used was the hypothetical-deductive, using as an instrument the bibliographic research for the study of interdisciplinary doctrines and scientific publications as it pertains to the problem. The results obtained pointed to “jeitinho” as an aspect of Brazilian culture, and under Kelsen's viewpoint, there are distortions of law in which the legal system of public management itself was created with links of subjectivity providing opportunities for the formation of societies focused on the practices of Corruption and improbity that contradict legal norms, therefore, are considered abnormal.
