O PROCESSO ESTRUTURAL EM POLÍTICAS PÚBLICAS SOB A ÓTICA DA LEGITIMIDADE POR REFLEXIVIDADE
Abstract
This article is dedicated in studying the structural legal process and its legitimacy in the social rights concretion starting from the jurisdictional management and control of public policies. The judicialization and implementation phenomenon of public policies is addressed by the Judiciary and its leading role in decision-making, which is justified by the constitutional necessity of conceiving effectiveness to the fundamental social rights, through a reformulation of its jurisdictional function. It discusses the institutions of the structural judicial process, adressing that the procedure chosen by the Courts, presents itself as being rich in effectiveness, as a result of the several social actors integration in the construction of the adequate solution for the concrete case. It is proposed that the incorporation of such legal procedure should be based on the premises of the theory of legitimacy of juridicial decisions by reflexivity, given the need for decisions that solve such social problems, for today and for the future. The study was carried out using the deductive method, with bibliographical research on the subject.
