ANULAÇÃO E REVOGAÇÃO DE EDITAIS LICITATÓRIOS: UM ESTUDO DOS MOTIVOS DE SUA OCORRÊNCIA NO MUNICÍPIO DE MARINGÁ

Abstract

The research aims to identify the justifications presented by the Municipality of Maringá-PR to annul or revoke the bidding processes in the years 2019 and 2020. The data were obtained by consulting the Transparency Portal of the municipality of Maringá-PR and analyzed the light of the research proposition. A total of 1,665 bidding procedures were analyzed in that period. A theoretical review on the subject was elaborated so that the current legislation and adequate understanding of the subject could be mastered. The research is methodologically classified as descriptive, applied in nature and with a mixed approach to the problem. There were three technical procedures used, namely: Bibliographic, documentary and ex-post facto research with a deductive approach. The study includes 1,523 approved processes, 71 revoked, 2 annulled, 25 declared deserted, 13 declared failed, 28 in progress and 03 suspended. The results showed that the most used modality was the Auction, with 37.77% of occurrence and with effectiveness, which totaled 541 and 629 Auctions, that is, 86.01% Auctions were approved. The study also pointed out that there is no disclosure of justifications for revocations or cancellations in terms of publication of the bidding processes, in full, on its transparency portal, in breach of current legislation; it was identified that only 14 out of a total of 56 annulled or revoked processes in which there is only one published Dispatch indicated some reason; in 30 cases out of a total of 56, there is an illustrative Dispatch; and at 12 there is no published order.
