THE CLAIM OF THE HUMANIZATION OF BRAZILIAN CRIMINAL JUSTICE
Abstract
Brazil also has a very punitive and retributive penal system. This way of looking at criminal conflicts can create severe problems of crime. It is understood that these tribulations exist since criminal conflicts are not fully resolved at the end of the judicial process. Normally with the final decision, there is not necessarily an end to the sociological conflict. It is also observed that in the process there is a leading role in a triangulation of relations, between judge, prosecutor and lawyer, to the detriment of a secondary nature not only for the aggressor, but above all for the victim. In this area, the need arises to understand the relevance of including the victim in the resolution of criminal conflicts, especially in meeting the needs arising after the offense or crime committed. In addition, look for ways to include it in the process, addressing philosophy and restorative techniques as a central point of this research.
